1. Client represents to be at least 21 years of age and legally capable of entering this contract under New Jersey law.
2. Client hereby verifies that the pickup date, time, number of passengers and billing information are correctly stated.
3. Client hereby authorizes Wine Tours Galore to charge a 50% deposit, to the credit card on file, at the time of reservation, which is non-refundable. Client acknowledges and accepts the Wine Tours Galore’s no refund policy. All reservations and payments are final.
4. Client agrees that his/her party will not exceed the passenger capacity of vehicle provided.
5. Neither the Wine Tours Galore, its agents or employees shall be liable for any personal property of the client or client’s guests, which are misplaced, damaged, or left in the vehicle. Wine Tours Galore shall not be responsible for the safe keeping of any such item.
6. Client assures that no passenger under 21 shall consume alcoholic beverages. SMOKING, ILLEGAL USE OF ALCOHOL (if passengers are under the age of 21), AND/OR NARCOTICS OR CONTROLLED SUBSTANCES ARE PROHIBITED AND WILL RESULTS IN ADDITIONAL CHARGES AND IMMEDIATE TERMINATION OF THE TRIP.
7. Wine Tours Galore shall not be liable for any damage arising out of car Wine Tours Galore’s inability to perform due to inclement weather, mechanical difficulties, delays due to traffic conditions or any unforeseen events beyond the reasonable control of Wine Tours Galore. If for any reason Wine Tours Galore cannot provide the service contracted, Wine Tours Galore’s liability is limited to the return of the deposit.
8. Our Drivers have the right to terminate the trip, without refund, if he/she feels that the party is not abiding by the Wine Tours Galore rules or is putting the vehicle or the driver at risk.
9. Client is responsible for all damages incurred to the car committed by his/her party during the service time, a fee of $250 dollars will be incurred if there is any vomiting in the car or on the car itself.
10. Any balance due must be paid 1 day before the event. Balance may be paid by the same credit card that the initial reservation was made (In some cases, cardholder must be present with credit card & ID upon arrival on rental date). You can also pay in full when making the reservation.
11. Client understands the cancellation fee is 50% of the total reservation price (NOT DEPOSIT) whichever is greater if cancelled before 48 hours of the scheduled trip.
If services are cancelled within 14 days of the scheduled trip, a cancellation fee of the entire reservation price (NOT DEPOSIT) applies.
12. Client understands that there will be no eating, smoking, or vaping allowed in the car. If client violates this policy by eating, smoking, or vaping, the trip will be TERMINATED immediately, and NO REFUNDS will be provided.
13. Client understands any changes to the contract, once signed, will result in a price increase.
14. There is only a 15-minute grace period given for point-to-point service.
15. Overtime will be permitted, upon vehicle availability, and rounded off to the next hour. Availability of overtime is not guaranteed. Overtime rates are non-negotiable and will be charged to the client according to the GPS Tracking report for each car. Drivers’ do not have the ability to waive overtime for any reason. Overtime is charged by the hour not prorated per minute.
16. Once this contract is signed, the contract price is fixed, and can only be altered to accommodate the increase of costs associated with additional services added. Early dismissal, downsizing, or shortening of rental hours will not adjust the contracted price.
17. Minor changes to rental are upon availability and REQUIRE A MINIMUM OF 48 HOURS NOTICE. CHANGE REQUESTS MUST BE emailed to info@winetoursgalorenj.com. Any changes in arrival or destination locations may result in additional charges (travel charges).
18. The Driver inspects each vehicle before, during and after each rental. In the event of damage Client shall be responsible for all harm and damages suffered by the Wine Tours Galore, its agents, employees, or third parties, including but not limited to the vehicle, regarding cleaning, breakages, burns, or other interior or exterior damage to extent of the actual cost to repair or replace, with a minimum charge of $200.00. NO EATING in the vehicles! Exterior decorations and red carpet subject to weather.
19. Upon notification of damages, Wine Tours Galore shall charge to client’s credit card on file for the following additional fees: damages, overtime, and/or any changes due that were not immediately paid by the client; Client agrees that Wine Tours Galore is expressly authorized to charge all ancillary costs that were not applied to the credit card on file when initially signing the contract for services.
20. Except in the case of willful misconduct or gross negligence of Wine Tours Galore, its agents or employees, client hereby waives all claims against Wine Tours Galore, its agents or employees for injury, loss, or damage, including consequential damages, to client’s person or property from whatever cause. In addition, client waives any right of subrogation regarding the same.
21. Client understands and accepts that Acts of God, unforeseen traffic, and severe weather conditions delay travel. There may be unexpected vehicle breakdowns and other unforeseen events beyond the control of Wine Tours Galore, for which Wine Tours Galore shall not be liable to client. There shall be no recourse for any of the same. In the event of a vehicle breakdown, all efforts will be made to supply a replacement vehicle. If a replacement vehicle is sent &/or client refuses a replacement vehicle, no refund is due. If no replacement vehicle is available, refund shall be limited to the amount paid by client. In case of an emergency, the Wine Tours Galore may subcontract his rental to another car service. The Wine Tours Galore is not responsible to fulfill itineraries developed by the client, which indicate a time that the client expects to arrive at certain locations after the initial pick-up time.
22. Wine Tours Galore reserves the right to institute and establish rules and regulations of guest conduct, which may be amended from time to time, including termination of rental, without refund, due to non-compliant guest conduct.
23. Written additions and/or alterations by the client, without written agreement of the Wine Tours Galore, are invalid and unenforceable.
24. Vehicles are sold and /or updated at the discretion of management. Vehicle requests are not guaranteed.
25. Cancellation Policy: Cancellations must be in writing and emailed to info@winetoursgalorenj.com. Cancellation fee is 50% of the total rental price or $300.00 whichever is greater.
26. DEPOSITS AND PAYMENTS ALWAYS REMAIN NON-REFUNDABLE AND NON-TRANSFERRABLE
